Outfity Terms of Service

These Terms of Service ("Terms") govern your access to and use of Outfity, including the Outfity mobile app, website, backend services, AI features, subscriptions, and related services (together, the "Service"). "Outfity", "we", "us", and "our" refer to Outfity as the provider of the Service.
Please read these Terms carefully. By creating an account, accessing, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. The Service
Outfity is an AI-powered wardrobe and outfit planning app. The Service may include digital wardrobe management; clothing upload, background processing, item classification, and item detail editing; outfit creation, layout editing, OOTD records, calendar views, and wear tracking; Daily AI LOOK and other outfit recommendations; weather-aware styling context; outfit photo parsing, item beautify, virtual try-on, model image management, and related AI tools; AI points, subscriptions, and other paid features.
The Service will evolve over time. We may add, change, limit, suspend, or remove features, including free, trial, paid, AI, or experimental features.
2. Eligibility
You must be at least 13 years old, or the minimum age required by your local law, to use the Service. If you are under the age of majority in your location, you may use the Service only with permission and supervision from a parent or legal guardian.
You may use the Service only if you can legally enter into these Terms and comply with applicable laws.
3. Account Registration and Security
You may need an account to use some or all of the Service. You agree to provide accurate information and keep it up to date.
You are responsible for keeping your account, device, password, and login credentials secure. If you use Apple Sign in, Apple's own terms and privacy policy also apply to that authentication flow.
You must not use another person's account without permission, impersonate another person or entity, create accounts using false or misleading information, sell or transfer account access in a way that violates these Terms, or attempt to bypass authentication, entitlement, subscription, or usage-limit systems.

4. Your Content
"Your Content" means photos, images, wardrobe items, outfits, OOTD records, notes, model images, tags, preferences, feedback, and other content or data that you upload, create, save, or submit through the Service.
You keep ownership of Your Content. You grant Outfity a limited, non-exclusive, worldwide, royalty-free license to host, store, copy, process, display, modify, transform, and create technical or AI-generated outputs from Your Content only as needed to provide and operate the Service, sync and back up your wardrobe and outfits, generate item attributes and AI outputs, troubleshoot, secure, maintain, and improve the Service, comply with law, and enforce these Terms.
This license is not intended to give Outfity ownership of your wardrobe, photos, or personal style data. We will not sell your personal wardrobe photos.
You represent that you have the rights needed to upload and use Your Content, and that Your Content does not violate any law, third-party rights, or these Terms.
5. AI Features and Styling Recommendations
Outfity uses AI and automated systems to help identify clothing, generate outfit recommendations, produce virtual try-on or beautified images, parse outfit photos, and create explanatory text.
AI outputs are provided for inspiration and convenience only. They may be inaccurate, incomplete, unavailable, or unsuitable for your body, wardrobe, weather, occasion, safety needs, workplace rules, cultural context, or personal preference. You are responsible for deciding whether and how to use any recommendation or generated output.
Outfity does not guarantee that AI-recognized item attributes are correct, that an outfit recommendation is the best or most appropriate choice, that weather-aware recommendations perfectly match actual weather or comfort needs, that generated images accurately represent real-world fit, fabric, color, texture, body shape, or item availability, or that AI features will always be available, fast, or error-free.
You should not rely on the Service for professional, medical, legal, safety-critical, or emergency advice.
6. Paid Features, Subscriptions, and AI Points
Outfity may offer paid subscriptions, AI points, consumable items, non-consumable features, trials, promotional access, or other paid benefits.
Purchases made through the iOS app are processed by Apple through Apple in-app purchase. Apple, not Outfity, processes your payment method and may handle billing, renewals, cancellations, and refund requests.
6.1 Subscriptions
If you buy an auto-renewable subscription, the price, billing period, renewal terms, and included features are shown in the purchase flow before confirmation. Your subscription renews automatically unless canceled according to Apple's rules before the renewal date. You can manage or cancel the subscription through your Apple ID, App Store account settings, or the in-app subscription management link when available. Deleting the app or deleting your Outfity account does not automatically cancel an Apple subscription.
6.2 AI Points and Usage Limits
Some AI features may require AI points or be subject to daily, monthly, account-level, subscription-level, or technical usage limits. Point costs, free allowances, and limits may vary by feature, subscription status, promotion, region, or app version.
Unless required by law or Apple's rules, used AI points, expired promotional points, and already-consumed AI outputs are not refundable.
6.3 Refunds
For purchases made through Apple in-app purchase, refund requests are handled by Apple according to Apple's policies. Outfity may receive refund or cancellation status from Apple and may adjust your subscription, entitlement, or AI point balance accordingly.
7. Acceptable Use
You agree not to misuse the Service. You must not violate applicable law, upload illegal or harmful content, infringe third-party rights, upload images of people without appropriate rights or consent where consent is required, create misleading or harmful AI-generated content, reverse engineer or disrupt the Service, bypass subscriptions or AI point systems, use bots or automated systems to consume AI resources, introduce harmful code, use the Service to train competing AI or recommendation systems without permission, or resell or commercially exploit the Service except as expressly permitted by us.
We may remove content, limit access, suspend accounts, or take other reasonable action if we believe these Terms have been violated.
8. Third-Party Services
The Service may depend on or link to third-party services, including Apple, App Store, Apple Sign in, Apple Weather / WeatherKit, cloud providers, AI providers, payment infrastructure, analytics or diagnostic tools, and external websites.
Third-party services are governed by their own terms and privacy policies. We are not responsible for third-party services, data, content, policies, downtime, pricing, billing decisions, weather accuracy, AI model behavior, or refund decisions.
9. Service Availability and Changes
We work to keep Outfity useful and reliable, but we do not guarantee that the Service will be uninterrupted, secure, error-free, or available at all times.
The Service may be affected by maintenance, updates, network issues, device limitations, operating system changes, App Store review requirements, third-party provider issues, AI provider outages, weather data availability, or other events outside our control.
We may modify, suspend, or discontinue any part of the Service at any time. Where reasonably practical, we will try to provide notice of material changes that significantly affect paid features.
10. Account Deletion and Termination
You may stop using the Service at any time. Where available, you may delete your account in the app, or contact us at outfity.app@gmail.com.
We may suspend or terminate your access to the Service if you violate these Terms; your use creates security, legal, operational, payment, or fraud risk; we are required to do so by law, platform rules, or a third-party provider; or we discontinue the Service or a material part of it.
After termination or account deletion, your right to use the Service ends. Certain sections of these Terms will continue to apply, including sections about Your Content license for completed processing, payment records, disclaimers, liability limits, dispute resolution, and legal compliance.
Account deletion does not automatically cancel an Apple subscription.
11. Intellectual Property
Outfity and its software, design, interface, trademarks, logos, text, graphics, layouts, systems, models, prompts, workflows, and other materials are owned by us or our licensors and are protected by intellectual property laws.
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own lawful personal use.
You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Service except as allowed by law or with our written permission.
12. Feedback
If you send us feedback, ideas, bug reports, or suggestions, you allow us to use them without restriction or compensation to you. We may use feedback to improve Outfity, but we are not required to do so.
13. Disclaimers
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and reliability.
We do not guarantee that your wardrobe data, AI outputs, weather data, purchase status, or synced content will always be accurate or current; that generated images or try-on results will match real-world appearance; that the Service will meet your needs; or that data loss, interruption, or third-party errors will never occur.
Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.
14. Limitation of Liability
To the maximum extent permitted by law, Outfity will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, device access, wardrobe records, subscription benefits, AI outputs, or business opportunities.
To the maximum extent permitted by law, our total liability for any claim related to the Service will not exceed the greater of the amount you paid to Outfity through the Service in the 12 months before the event giving rise to the claim, or USD 50.
Nothing in these Terms limits liability that cannot be limited under applicable law.
15. Indemnity
You agree to defend, indemnify, and hold harmless Outfity from claims, losses, liabilities, damages, costs, and expenses arising from Your Content, your misuse of the Service, your violation of these Terms, your violation of law or third-party rights, or your attempt to bypass payment, subscription, AI point, or security systems.
16. Changes to These Terms
We may update these Terms from time to time. If changes are material, we will provide notice by updating the effective date, posting the revised Terms, or using other reasonable methods. Your continued use of the Service after updated Terms become effective means you accept the updated Terms.
17. Governing Law and Disputes
These Terms are governed by the laws that apply to Outfity and to your use of the Service, without regard to conflict-of-law rules, unless mandatory consumer protection laws in your location require otherwise.
If a dispute arises, please contact us first at outfity.app@gmail.com so we can try to resolve it informally. If we cannot resolve it, the dispute will be handled by a court or other forum with proper jurisdiction under applicable law.
